Petitioner seeks bail in Masrak P.S. Case No.371 of 2018 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code.
Counsel for the petitioner submits that there is case and counter case between the parties. Son of the informant has also filed Mashrak P.S. Case No.370 of 2018 against the informant and others in which wife and daughter-in-law of the petitioner have sustained injuries whose injuries reports have been enclosed as Annexure-4.
In the instant case, it is submitted that this petitioner assaulted the informant with Gandasa over her head. Injury report of the informant is enclosed as Annexure-2 from which it
Patna High Court CR. MISC. No.42723 of 2019(2) dt.17-07-2019 2/2 appears that she has sustained one injury on her head which was 11⁄2" x 1⁄4" x scalp deep which was opined by the Doctor to be simple in nature.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, VI, Saran at Chapra, in connection with Masrak P.S.
