Petitioner apprehends his arrest in connection with Pirbahore P.S. Case No. 464 of 2009 registered for the offences punishable under Sections 467, 468, 471, 420 and 34 of the Indian Penal Code.

Allegation as per FIR is that one letter has been received from the Governor Secretariat for taking admission of some boys and petitioner is also one of them.

Submission of learned counsel for the petitioner is that he has not taken any benefit of the letter and the other co-accused person has been granted privilege of anticipatory bail by coordinate Bench of this Court vide order dated 5.4.2018 passed in Cr.Misc.No. 13711 of 2018.

Patna High Court Cr.Misc. No.17961 of 2018 (3) dt.25-04-2018 2/2 Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioner on the ground that already process under Section 82 Cr.P.C. has been issued against the petitioner and as he is absconding he is not entitled to privilege of anticipatory bail.

Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which will be considered on the basis of above submission.

With the above observation, this application is disposed of.
