JUSTICE PARTHA SARTHY ORAL ORDER 07-04-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Madhepura P.S. Case no. 610 of 2020 registered under section 395 of the Indian Penal Code.

As per allegation in the F.I.R., six accused persons on three motorcycles, on the point of revolver, are stated to have looted the driver of the informant who was returning on the informant's tractor along with the trailer.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against six unknown. The name of the petitioner transpired in course of investigating on the confessional statement of co-accused Randhir Yadav and Indu Kumar made before police. No incriminating article has been

No.41140 of 2020(3) dt.07-04-2021 2/2 recovered from the person of the petitioner who inspite of being in custody since 13.8.2020 and charge sheet having been submitted in the case, he has not been put on T.I. parade. It is further submitted that co-accused Suman Kumar has been enlarged on bail vide order contained in Annexure-2 to the petition.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner and the petitioner not having been put on T.I. parade inspite of being in custody since 13.8.2020 and charge sheet having been submitted in the case, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Madhepura P.S. Case no. 610 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura.
