The petitioner apprehends his arrest in connection with Barauni P.S. Case No.212 of 2020, registered for the offence punishable under Section 392 of the Indian Penal Code. As per the FIR, three accused persons are said to have snatched the motorcycle, mobile phone and cash Rs.11,300/- from the informant and fled away.

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner is not named in the FIR. It is further submitted that the name of the petitioner surfaced in the case on the basis of confessional statement of co-accused, Vidyanand Sahni. No incriminating

Patna High Court CR. MISC. No.54078 of 2021(3) dt.07-07-2022 2/2 article has been recovered either from the house of the petitioner or from possession of the petitioner.

The learned APP for the State opposed the prayer for anticipatory bail of the petitioner and submitted that the petitioner has got criminal antecedents also. Taking into consideration the facts aforesaid and the fact that the petitioner has got criminal antecedents, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
