Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 140(2) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner has antecedent of two cases and in sum and substance the allegation in the FIR is that informant alleges that his brother was abducted.

The learned counsel appearing on behalf of the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that the brother of the informant came back within 4-5 hours of the occurrence, and his statement was recorded under Section 180
Patna High Court CR. MISC. No.44712 of 2025(3) dt.09-09-2025 2/2 BNSS, as has been pleaded at Para-8 of the anticipatory bail application, wherein the victim has not supported the case of the prosecution, rather has stated that he had accompanied the accused persons on his own sweet will.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sikta P.S. Case No. 56 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.
