The petitioner apprehends his arrest in Tekari P.S. Case No.283 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has committed no offence and has falsely been implicated in the present case on mere suspicion. It is further submitted that nothing has been recovered from conscious possession of the petitioner and the petitioner has got no concern with the seized material. The petitioner has no criminal antecedent.

Learned A.P.P. has vehemently opposed the prayer for anticipatory bail of the petitioner. It is submitted that the petitioner is named in the F.I.R. 6 litres of country made liquor

Patna High Court CR. MISC. No.951 of 2021(2) dt.28-10-2021 2/2 was recovered from the house of the petitioner. Therefore, the petitioner does not deserve anticipatory bail. Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
