The petitioner has filed the instant application for grant of regular bail in connection with Muffasil P.S. Case no. 183 of 2020 registered under sections 406, 407 and 420 of the Indian Penal Code.

As per allegation in the FIR, the petitioner is the driver of the informant and he was given a sum of Rs. 1,68,270/- in cash by the trader for being carried to the informant. It is further stated that he cheated the informant of the said amount and falsely narrated that the said amount was snatched away by the miscreants while he was on way. It is submitted by learned counsel for the petitioner that the allegations as narrated in the FIR are false and incorrect.

The petitioner has been falsely implicated in this case for the reason that he was asking for the due salary of the period of COVID-19 Pandemic from the informant. It is submitted that the petitioner has no criminal antecedent and he is in custody since 10.8.2020. Chargesheet has been submitted in the case.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case together with the period in custody, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Mufassil P.S. Case no. 183 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st, Katihar.
