The petitioner apprehends her arrest in Phulwari Sharif P.S. Case No. 175 of 2011 registered for the offence punishable under Section 290 of the Indian Penal Code and under Sections 47 (A)(C)(D)(E) and (F) of the Bihar Prohibition and Excise Act. The hut of the petitioner and others were searched and from the hut of the petitioner 15 liters of country made liquor was recovered.
Learned counsel for the petitioner submits that the petitioner is a lady. The husband of the petitioner was not made accused. The petitioner had no knowledge about her implication in the case. The petitioner has got six months' child in her lap. Of course, the case is of the year 2011 but considering
Patna High Court Cr.Misc. No.11301 of 2017 (2) dt.04-04-2017 2/2 the facts that the petitioner is a lady and she has got six months' child in her lap, the petitioner above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Patna in Phulwari Sharif P.S. Case No. 175 of 2011, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
