The petitioner seeks bail in connection with Teghra P.S. Case No. 231 of 2023 instituted for the offence under Sections 341, 323, 379, 385, 307 & 34 of the Indian Penal Code and Section 27 of the Arms Act.

The informant alleged that on 23/07/2023 at about 2:30 P.M., his son Kunal Kumar went to demand his lent money from the petitioner and another person and instead of returning the money, they assaulted, abused, and chased him while firing shots. They later followed him to his house, threatened to kill him, and demanded a ransom of one lakh rupees. 4.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.49368 of 2025(2) dt.31-07-2025 2/3 that the petitioner is in custody since 14-02-2025. Petitioner bears two criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Nothing has been recovered from the possession of the petitioner. From perusal of the FIR, it would reveal that no injury is sustained by anyone. There is no specific allegation against the petitioner. Learned counsel for the petitioner drew attention of this court towards the impugned order, wherein charge sheet is submitted under Sections 341, 323, 504, 307/34 of the IPC.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no injury to anyone and charge-sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Teghra P.S.

Patna High Court CR. MISC. No.49368 of 2025(2) dt.31-07-2025 3/3 Case No. 231 of 2023, subject to the following conditions: (I) One of the bailors shall be own/close member of the family of the petitioner.

(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
