JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-01-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Amba P.S. Case No. 34 of 2021 (General Administration No. 445/2021), registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

2625 litres of spirit has been recovered from a truck and the co-accused persons who were apprehended on the spot disclosed the name of this petitioner as liner. It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question and has got no concern with the seized liquor. Petitioner is in custody since 18.06.2021. Investigation is complete.

Patna High Court CR. MISC. No.54442 of 2021(2) dt.29-01-2022 2/2 Learned APP however vehemently opposed the prayer for bail and submitted that petitioner has got criminal antecedents of similar nature.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge Excise Act, Aurangabad in connection with Amba P.S. Case No. 34 of 2021 (General Administration No. 445/2021), once the charge is framed in the case.
