JUSTICE BIRENDRA KUMAR ORAL JUDGMENT Date: 11-08-2017 The present writ application has been filed for a direction to the respondent authority to investigate Hisua P.S. Case No.87 of 2014, a case under Section 302/201/34 of the IPC registered against unknown by the local Chaukidar and a complaint of that occurrence bearing Complainant Case No.536 of 2014 lodged by the petitioner against the named accused persons. Both the cases have merged into one case. However, police is not investigating the case properly and is in collusion with the accused persons.
The supplementary counter affidavit filed on behalf of
Patna High Court Cr. WJC No.772 of 2015 dt.11-08-2017 P2/ respondent No.3 by Sub-Divisional Police Officer, Sadar, Nawada, would reveal the details of the background of the case and suspicion of commission of crime by the petitioner also. The case is still under investigation. The counter affidavit further reveals that investigation is going on proper track.
In the circumstances, I do not find merit to interfere in the matter at this stage. Accordingly, this application stands disposed of with direction to the investigating agency to complete the investigation preferably within three months from today.
