Petitioner apprehends his arrest in connection with Sultanganj P.S. Case No. 78 of 2013 registered under Sections 21 and 22 of the N.D.P.S. Act.
Learned counsel for the petitioner submits that he has falsely been implicated in the present case. Nothing has been recovered from his possession. His name has come on the confessional statement of co-accused and the same has no evidentiary value in the eye of law. Other co-accused from whose possession illegal Ganja was recovered, has been acquitted by the learned Court below by order dated 11.04.2016 in N.D.P.S. G.R. No. 1395 of 2013 which is appended as Annexure 2 to this
Patna High Court Cr.Misc. No.4171 of 2017 (2) dt.20-02-2017 2/2 application.
Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhagalpur in connection with Sultanganj P.S. Case No. 78 of 2013 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Arvind Srivastava, J) Prakash/- U T
