The petitioner seeks bail in Deep Nagar P.S. Case No. 285 of 2018, instituted for the offence under Section(s) 379 and 461 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. He has been arrested merely on suspicion. Counsel for the petitioner further submits that other co-accused with similar allegation have already been granted bail by this Court and coordinate Bench of this Court vide orders dated 6.5.2019 and 23.5.2019 passed in Cr. Misc. Nos. 29088 of 2019 and

Patna High Court CR. MISC. No.42401 of 2019(2) dt.15-07-2019 2/2 33924 of 2019 respectively.

Petitioner is in custody since 21.01.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhiharsharif at Nalanda, in connection with Deep Nagar P.S.
