Petitioner was granted pre-arrest bail with certain conditions vide order dated 08.11.2016 passed in Cr. Misc.no.43932/2016 but due to demonetization, he could not deposit the amount as directed by this court and subsequently, he filed Cr. Misc.no.3126/2017 for extension of period for deposit of amount but he did not pray for extension of time to surrender before the court below. However, the petitioner was permitted to deposit the amount vide order dated 08.11.2016 passed in Cr. Misc.no.43932/2016. Thereafter, petitioner has filed this modification petition for extension of period of surrender in connection with Complaint case no. 1004/2013 pending in the court of Sri Ravi Ranjan, Judicial Magistrate, I st Class, Patna/ concerned court.

Patna High Court Cr.Misc. No.13044 of 2017 (2) dt.26-04-2017 Learned counsel appearing for the opposite party no.2 raises no objection, if time of surrender is extended by this court. Accordingly, this modification petition stands allowed. Petitioner is permitted to surrender before the above stated court within four weeks from the date of receipt/ production of a copy of this order to the concerned court.
