The petitioner has preferred this application for grant of regular bail in a case registered under sections 399 and 402 of the Indian Penal Code and section 25(1-B)(a), 26 and 35 of the Arms Act.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 24.8.2021 (Annexure 1) passed in Cr. Misc. no. 14191 of 2021 giving liberty to the petitioner to renew his prayer for bail after framing of charge. It is submitted that the order framing charge dated 8.3.2021 has been brought on record as Annexure 3 to the petition. The petitioner is in custody since 5.9.2020 and undertakes to co-operate in the trial.

Having heard learned counsel for the parties and taking into consideration the observation given in the aforesaid order dated 24.8.2021 together with charge having been framed in the learned trial Court, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no. 5 of 2021 (arising out of Laheriasarai P.S. Case no. 428 of 2020) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XI, Darbhanga.
