JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-03-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in Paliganj Police Station Case No. 96 of 2019 registered for the offences punishable under sections 498A/304B/201/34 of the Indian Penal Code.

As per the prosecution case, petitioner and his family members killed informant's daughter due to non-fulfilment of demand of dowry and secretly disposed of the dead body. Learned counsel for the petitioner submits that the petitioner is husband of the deceased and in fact the deceased had affair with some other person and she committed suicide when her parents married her with the petitioner. Petitioner is in custody since 5.6.2020.

Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.40839 of 2020(2) dt.01-03-2021 2/2 bail and submits that there is specific allegation of demand of dowry and torture against the petitioner who is the husband of the deceased. The deceased died within seven years of marriage at her in-laws house under unnatural circumstances. In view of the nature and gravity of the offence and allegation against the petitioner, his prayer for bail is refused. (Prabhat Kumar Singh, J) Shashi U T
