JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and the learned APP for the State.
The petitioner is apprehending his arrest in connection with Parsa P.S. Case No. 06 of 2017 registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that co-accused, namely, Krishna Kumar, who has been arrested for the same offence, has been granted regular bail and the petitioner has got no criminal antecedent.
Heard the learned APP also.
In view of the section 76(2) of Bihar Excise and Prohibition Act, 2016, I am not inclined to enlarge the petitioner
Patna High Court Cr.Misc. No.12607 of 2017 (2) dt.30-03-2017 2/2 on anticipatory bail. The petitioner should surrender before the court below and make a prayer for regular bail. The learned court below shall consider the submission of the petitioner as stated above and shall also consider the materials available on record and pass an appropriate order without being prejudiced by the order of this Court, preferably on the same day.
