==================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 02-05-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 1347 of 2016/ Tr. No. 2662 of 2017 for the offence punishable under Sections 406 and 420 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the complaint has been lodged against altogether three persons out of which two namely, Pawan Kumar and Aalok Kumar

Patna High Court CR. MISC. No.27080 of 2018(12) dt.02-05-2019 2/2 have already been granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 5244 of 2018 and the case of this petitioner stands on similar footing. Moreover, the complaint has been lodged after much delay from the date of occurrence which itself creates doubt over the prosecution version. The complainant has failed to produce any valid document with respect to transaction of money before the court below. Hence, the petitioner may be granted the privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the, above named, petitioner in the event of surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., East Muzaffarpur in connection with Complaint Case No. 1347 of 2016/ Tr. No. 2662 of 2017 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
