JUSTICE SHIVAJI PANDEY ORAL ORDER 04-02-2016 Heard learned counsel for the petitioner and learned counsel for the State.
In this case, the petitioner has sought relief for acceptance of his application form for the purpose of appointment as Assistant Teacher in the High School, claiming to have requisite qualification as he has already passed the Secondary Teacher Eligibility Test (STET).
Learned counsel for the petitioner submits that he has filed an application against the advertisement issued by the State of Bihar with regard to the appointment of Secondary Grade Teacher. The application of the petitioner was accepted, which is apparently clear from Anneuxres-4 and 5 to this writ petition, but the respondents orally communicated the petitioner that his case could not be considered as there is no vacancy for Social Science Teacher.
There is no document on record to show that the application of the petitioner has been rejected and the petitioner
Patna High Court CWJC No.2974 of 2013 (3) dt.04-02-2016 3/3 has not averred anywhere in the writ petition that any person has been appointed as Social Science Teacher.
In such view of the matter, the petitioner is at liberty to file a proper representation before the District Education Office, Nalanda, who will examine the case of the petitioner and try to resolve the dispute by passing a reasoned order. With the aforesaid observations and directions, this writ petition is disposed of.
