Petitioners seek bail in a case registered for the offence punishable under Sections 364, 34 of the Indian Penal Code.
Allegation against the petitioners is that they along with 15 others have kidnapped the son of the informant. Learned counsel for the petitioners submits that the petitioners are innocent, not named in the FIR and have been falsely implicated in this case. He submits that there is no specific allegation upon the petitioners rather specific allegation is upon co-accused Mishri Lal Choudhary. He submits that there is general and omnibus allegation against the petitioners. He
Patna High Court CR. MISC. No.557 of 2021(3) dt.23-03-2021 2/2 submits that charge-sheet has already been submitted and there is allegation of tampering with the prosecution witnesses by the petitioners. No TIP has been done as yet. He further submits that petitioners bear no criminal antecedent as stated in para-3 of the bail application and they are languishing in judicial custody since 23.08.2020.
Considering the facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Ladaniya P.S.
