The petitioner apprehends his arrest in Muzaffarpur Town P.S. Case No. 318/2008, registered for the offences punishable under Section 409 of the Indian Penal Code. During the course of inspection of Sub Post Office, Muzaffapur a sum of Rs. 50,000/- was found to have been misappropriated and for that Muzaffarpur Town P.S. Case No. 211/2007 was registered. But during the course of investigation it was found that altogether Rs. 37,00,000/- was misappropriated by the petitioner, as the petitioner did not deposit the amount taken from the different account holders in the post office. It is submitted that petitioner was suspended in the year
Patna High Court Cr.Misc. No.19490 of 2016 (3) dt.19-07-2016 2/2 2007 and he has already retired from service in the year 2012. The investigation is still pending. All the retiral benefits is withheld, but from the record itself, it appears that petitioner collected the money from different customers, but did not deposit the same in the account of post office and thereby petitioner misappropriated huge amount of Rs. 37,00,000/-.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
