JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Natwar P.S. Case No. 81 of 2016, registered under Sections 341, 323, 498A and 302/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant by her husband and in-laws due to non-fulfillment of demand of dowry.
Learned counsel for the petitioner submits that petitioner happens to be the husband of the deceased and his marriage was solemnized with the deceased, daughter of the informant, before 15 years. In fact, deceased, wife of the petitioner was pregnant and due to labour pain she was rushed to the hospital
Patna High Court Cr.Misc. No.19593 of 2017 (4) dt.02-08-2017 but she died in the way. Moreover, in the postmortem report, the death of the deceased was shown due to rapture in abdomen and internal bleeding.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Bikramganj, Rohtas, in connection with Natwar P.S. Case No. 81 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
