The petitioners have preferred this application for grant of regular bail in a case registered under sections 364, 382, 307 and 34 of the Indian Penal Code.

As per the prosecution case, the informant was kidnapped by the accused persons on the Bolero vehicle, which on hulla being raised by the informant and chased by the villagers, was intercepted and the informant was rescued. The three accused persons in the Bolero vehicle were caught and they happen to be the three petitioners herein. It is submitted by learned counsel for the petitioners

Patna High Court CR. MISC. No.54398 of 2021(3) dt.04-04-2022 2/2 that the petitioners have been falsely implicated in the case. No such occurrence as alleged has taken place. The parties have arrived at a compromise which was entered into four days after the alleged occurrence. The petitioners are in custody since 23.7.2021 and chargesheet has been submitted in the case. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the three petitioners having been caught at the place of occurrence itself in the Bolero vehicle which was used by them for kidnapping of the informant, the Court is not inclined to enlarge the petitioners on bail and the application is rejected.
