1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has renewed his prayer for grant of regular bail in connection with Dariyapur P.S. Case no. 73 of 2023 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, on a secret information having been received a raid was conducted. While three accused persons managed to escape which included the petitioner herein, on search 70 litres of liquor was recovered.

4. Learned counsel for the petitioner submits that the earlier prayer for bail of the petitioner was rejected vide order dated 17.10.2023 passed in Cr. Misc. no. 66915 of 2023 giving

Patna High Court CR. MISC. No.50460 of 2024(2) dt.19-07-2024 2/2 liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner has remained in custody for more than 1 year since 16.6.2023 and undertakes to cooperate in the trial.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R, the liberty granted to the petitioner in the earlier order of rejection dated 17.10.2023 and the petitioner having remained in custody for more than 1 year since 16.6.2023, the petitioner is directed to be enlarged on bail in connection with Dariyapur P.S. Case no. 73 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-2nd-cum-Exclusive Special Judge-1st Class, Excise, Saran at Chapra.
