JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Chhatapur P.S. Case no. 75 of 2015 registered under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code. The allegation of informant Ashok Prasad Mandal is that 45 persons named in the F.I.R., including the petitioner, had applied for the post of Panchayat Teacher submitting the forged T.E.T. Certificate.

Learned counsel for the petitioner submits that petitioner is said to be applied for the post of Panchayat Teacher submitting the forged certificate of T.E.T., but petitioner has not obtained the job and as such no loss has been caused to the exchequer. Further submission is that similarly situated co-accused, namely, Archana Anand has been granted Anticipatory Bail vide Criminal Miscellaneous No. 32346 of

Patna High Court Cr.Misc. No.9814 of 2016 (2) dt.21-04-2016 2/2 2015 on 18.08.2015 by a co-ordinate Bench of this Court. The petitioner having no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Supaul in connection with Chhatapur P.S. Case No. 75 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
