JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2017 The petitioners are apprehending their arrest in connection with Brahmpur P.S. Case No. 210 of 2016 registered for offences punishable under Sections 342, 323, 354(A), 420, 379, 504, 506 and 34 of the Indian Penal Code. It has been submitted on behalf of the petitioners that though there is allegation that the husband of the informant is not mentally fit and petitioners taking advantage of the said fact got the sale deed executed ten kathas of land from the husband of the petitioner in their favour and when the informant went to protest, she was assaulted and her Blouse was also torn by the accused persons.

Patna High Court Cr.Misc. No.9932 of 2017 (2) dt.06-03-2017 2/2 It has been submitted that it is a family dispute between the parties and now they want to settle the dispute. Heard learned A.P.P. also.

Having heard both sides and in view of the fact that there is an allegation that the petitioners have got some sale deed with respect to 10 Kathas of land from the husband of the informant, but nothing is in their support, considering that there is family dispute between the parties, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Brahmpur P.S. Case No. 210 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
