JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-04-2018 The petitioner is apprehending his arrest in connection with Ghorasahan P.S. Case No. 582 of 2017, registered for offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the minor daughter of the informant.

It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case and informant is in habit of filing such false cases as the petitioner was opposing the illegal act of the informant.

Learned counsel for the State opposed the prayer for bail on the ground that the girl has named this petitioner along with

Patna High Court Cr.Misc. No.14161 of 2018 (3) dt.26-04-2018 2/2 others, who kidnapped her with the purpose to sell her for prostitution.

Having heard both sides, considering the facts and circumstances of the case, nature of offence, I am not inclined to grant the privilege of anticipatory bail to the petitioner, this application is accordingly, dismissed.

However, the petitioner may surrender before the court below and pray for regular bail, which will be considered on the merit of the case.
