11/12 appearing on behalf of the petitioners, at the outset, seeks to avail remedy for the relief as prayed for in the present writ petition as per the provision of Clause 4.C(1) of the Bihar State Litigation Policy, 2011.
2. He informs that the individual petitioners will file their individual representation before the Director, Primary Education, Bihar.
3. The petitioners are aggrieved that the District Programme Officer (Establishment), Supaul is not exercising his jurisdiction.
4. The Director, Primary Education, Bihar is directed to call for the particulars relating to the petitioners and all the applications from the office of the District Programme Officer (Establishment), Supaul and redress the grievance of the petitioners in accordance with law expeditiously.
5. In Babu Verguese vs. Bar Council of Kerala reported in (1999) 3 SCC 422, the Apex Court observed that "it is a basic principle of law that if the manner of doing a particular act is prescribed under any statute, the act must be done in that manner or not at all". (Taylor vs. Taylor:(1875) LR
(1) CH-D-426, and Nazir Ahmad vs. King Emperor: AIR 1936 PC 253), the apex Court observed that "when the power is given

6. The writ petition is against the inaction on the part of the District Programme Officer (Establishment), Supaul for having not taken immediate steps to consider the case of the petitioners. In this regard, the Additional Chief Secretary, Education Department, Government of Bihar, Patna may take appropriate action to ensure that the authorities subordinate to him vested with quasi judicial power act as per the statutory provision vested in them.
7. The writ petition stands disposed of.
