2. The petitioner seeks regular bail in connection with Garahiya Bazar P.S. Case No. 03 of 2026 registered for the offence under Sections 87, 140(3), 61(2), 64, 65(1), 115(2), 127(2), 351(2), 351(3), 3(5) of the BNS and under Sections 4, 6 of the POCSO Act.

3. As per the prosecution case, the petitioner is alleged to have committed rape with the victim and other persons are said to have assaulted her.

4. The petitioner is in custody since 12.01.2026.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

6. Learned APP for the State has opposed the application of the petitioner and has submitted that the victim girl, in her statement recorded under Section 183 of the BNSS, has supported the prosecution case.

7. In view of the aforesaid, this Court is not inclined to grant bail to the petitioner.
