The petitioner apprehends his arrest in connection with Kishanganj P.S. Case No. 561 of 2016, registered for the offences punishable under Sections 392 of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act.
Allegedly, one co-accused Babar was apprehended and two others namely the petitioner and Muzzamil succeeded in fleeing away and it is alleged that the petitioner took away the bag containing cash and fled away and from Babar one loaded country made pistol and one live cartridge were recovered. Submission is of false implication and that the petitioner was not apprehended at the spot, nothing has been
Patna High Court Cr.Misc. No.11005 of 2017 (2) dt.20-03-2017 2/2 recovered from his possession, he has got no criminal antecedent and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. opposes the prayer of pre-arrest bail by submitting that in this case T.I.P. is required. In the facts and circumstances as stated above, I am not inclined to grant privilege of pre-arrest bail to him and accordingly his such prayer stands rejected in connection with Kishanganj P.S. Case No. 561 of 2016, pending in the Court of learned Chief Judicial Magistrate, Kishanganj. (Jitendra Mohan Sharma, J.) Rajiv/- U T
