The petitioners apprehend their arrest in Daudpur P. S. Case No. 16 of 2017 registered for the offences under Sections 30 and 36 of the Bihar Excise (Amendment) Act, 2016 On secret information, the police reached near the shop of Mantu Singh and caught one Chandeshwar Kumar Mahto near the shop of Mantu Singh and on search of the shop of Mantu Singh, different brands of Indian made foreign liquor were recovered.
Learned counsel for the petitioners submits that that the petitioners Pinku Singh and Santu Singh are brother of Mantu Singh.
The petitioners have no concern with
Patna High Court Cr.Misc. No.16178 of 2017 (2) dt.25-04-2017 2/2 shop of Mantu Singh. From the seizure list, it appears that from the shop of Mantu Singh, different brands of whiskey were recovered.
Considering the facts aforesaid and the fact that the petitioners are the brother of Mantu Singh and Mantu Singh was running a shop for that the petitioners have been made accused, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Saran, Chapra in Daudpur P. S. Case No. 16 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
