The petitioners are apprehending their arrest in connection with Raxaul P.S. Case No. 270 of 2014 for offences under Sections 147, 148, 149, 332, 323, 307, 353, 427, 379 of the Indian Penal Code.
In the present case, the police party was on round and when it reached near the Nepali Station Tumariya Tola, some persons, who were sitting there, started fleeing away and one person had fallen in the pond. The police again returned and saw huge persons were assembled near the pond and when the body
Patna High Court Cr.Misc. No.11869 of 2016 (2) dt.16-03-2016 was taken out, the people, assembled there, knocked down the S.I. Manoj Kumar and A.S.I. Narendra Kumar Shahi from the jeep and assaulted them. The police party came to the Hariya Police out post and the mob also surrounded the police station and damaged the government vehicle by setting fire.
Learned counsel for the petitioners submits that the names of the petitioners are not there in the First Information Report.
Looking to the entire facts and circumstances of the case, let the petitioners, namely, Firoz Mian, Saquoor Mian, Anwar Mian, Laddu Mian, Munna Sah and Mumtaz Mian, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Raxaul at Motihari in connection with Raxaul P.S. Case No. 270 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
