JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2017 The application is for grant of anticipatory bail in connection with Madhepura P.S. Case No. 679 of 2016 registered for offence under section 420 of the Indian Penal Code and sections 3, 5 and 6 of the Immoral Traffic (Prevention) Act, 1956. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case, as there is no evidence that he was running any beauty parlor but the allegation is that the informant was sent to do the work in the beauty parlor of the petitioner where her modesty was outraged, that is false implication, statement of the victim-girl has not been recorded under section 164 Cr. PC.

Having heard both sides and in view of the allegation

Patna High Court Cr.Misc. No.9959 of 2017 (2) dt.06-03-2017 2/2 made against the petitioner, this Court is not inclined to grant bail to him at this stage. However, he may surrender before the court below and make prayer for regular bail, which will be considered by the court below on its own merit without being prejudiced by this order.

Accordingly, this petition is disposed of.
