2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 307, 354, 504, 506/34 of the Indian Penal Code.
3. As per the prosecution case, these petitioners are alleged to have abused and assaulted informant and his family members by fists and slaps.
4. Learned counsel for the petitioners submits that petitioner No. 1 is own grandson and petitioner No. 2 is daughter-in-law of informant and both of them are next door
Patna High Court CR. MISC. No.48983 of 2024(2) dt.27-08-2024 2/2 neighbours. He next submits that due to land dispute this false and concocted case has been lodged against these petitioners. Injuries allegedly caused by these petitioners are simple in nature. Petitioners have got clean antecedent.
5. Learned counsel for the informant vehemently opposed the bail application.
6. Considering the backdrop of the case, simple nature of injuries and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Jokihat P. S. Case No. 121 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
