1. Heard Mr. Alok Kumar Alok, learned counsel for the petitioner and Mr. Binod Kumar No.3, learned APP for the State.

2. The petitioner seeks regular bail in connection with Bhagwanpur P. S. Case No. 89 of 2025, dated 07.04.2025 registered for the offences punishable under Sections 96 and 3(5) of the B.N.S.

3. The main submissions advanced by the petitioner's counsel are that the petitioner is a 60 year old lady, the main allegation is against her son namely, Lalan Kumar who allegedly kidnapped the informant's minor daughter, in fact, the said allegation is completely false. It is further submitted that the victim has been recovered and she has recorded her

Patna High Court CR. MISC. No.43802 of 2025(3) dt.21-07-2025 2/2 statement under Section 183 of the B.N.S.S. and while deciding the issue of her custody, the victim refused to go with her parents before the concerned court, which in itself falsifies the allegation of her kidnapping.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. Considering the aforesaid submissions advanced by the petitioner's counsel and mainly the petitioner's custody period and also the fact that the victim has been recovered and the main allegation is against the son of this petitioner, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Bhagwanpur P. S. Case No. 89 of 2025, on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
