2. The petitioner seeks bail in connection with Pachrukhi P.S. Case No. 165 of 2024 registered for the offence under Section 414 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to have caught with a stolen motorcycle.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in this case. He further submits that the petitioner has no criminal history and he is in jail since 9.5.2024.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, Siwan in connection with Pachrukhi P.S. Case No. 165 of 2024.

7. As a condition of this order, the Court below, before accepting the bail bonds of the petitioner will verify the criminal antecedent/s of the petitioner. If the Court below finds that the petitioner has no criminal history then his bail bonds shall be accepted by the Court below. If the Court below finds that the petitioner has any criminal history then appropriate orders shall be passed by the Court below.
