The petitioner seeks bail in a case registered under Sections 414/413 of the Indian Penal Code and Sections-25(1B)A/26 and 35 of the Arms Act. Allegedly, two live cartridges and cash Rs. 32,000/- is said to have been recovered from possession of the petitioner. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 19-12-2018. Charge sheet has already been submitted. Two live cartridges and cash Rs. 32,000/- is said to have been recovered from pocket of the petitioner. The owner of the motorcycle has filed a petition before the court below. From Annexure 2 of the petition, it is

Patna High Court CR. MISC. No.42529 of 2019(2) dt.10-07-2019 2/2 evident that the motorcycle in question is not a stolen property. The other co-accused with similar allegation has been granted bail by a coordinate bench of this court vide order dated 30-052019 passed in Cr. Misc. No. 21763 of 2019. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Ballia P.S. Case No. 355 of 2018.
