The petitioner apprehends his arrest in Shambhuganj P.S. Case No. 94/2016, registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code. The son of the informant had gone to Tarapur for purchasing rope and nail, but he did not return. The dead body of the son of the informant was found at Mirjapur Bandh. The informant suspected that the petitioner and other accused persons were on inimical term with him and they might have killed his son. Learned counsel for the petitioner submits that save and except suspicion, no tangible material is collected against the petitioner. Similarly situated co-accused Subhash Singh, Bipin Singh @ Aniket Anand and Bivash Singh @ Bibhash Singh have
Patna High Court Cr.Misc. No.19652 of 2017 (2) dt.07-07-2017 2/2 already been enlarged on anticipatory bail vide order dated 22.11.2016 passed in Cr. Misc. No. 43045/2016. Case of the petitioner stands on the same footing.
Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Banka in connection with Shambhuganj P.S. Case No. 94/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
