JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 18-02-2022 Heard the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Bikramganj P.S. Case No. 145 of 2018 instituted for the offences punishable under Sections 30(a)/36 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the recovery of the liquor has been from the bush near the village and the petitioner is being sought to be arrested on suspicion, whereas he is no manner connected in the said case neither he was found at the place of incident nor the area belongs to him. I have considered all the aspects, exfacie no case of Section 30(a) of the Act is made out, I am inclined to allow the petitioner on bail, in the event of arrest he shall be released on
