Petitioner apprehends arrest in connection with Sugauli P.S. Case No. 287 of 2016 registered under Sections 30A of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. Petitioner has been implicated in this case on confessional statement of co-accused due to previous enmity. Save and except the confessional statement of the co-accused, there is no material or evidence against this petitioner. Petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner, in the event of arrest or

No.12037 of 2017 (2) dt.30-03-2017 2/2 surrender within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Chamapran in connection with Sugauli P.S. Case No. 287 of 2016 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
