JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-09-2022 In pursuance to the last order dated 12.08.2022, the Additional Chief Secretary, Department of Education, Government of Bihar, Patna and the Director, Primary Education, Bihar, Patna are present in the Court and submit that as far as the amount of G.P.F., G.I.S. and Leave Encashment are concerned, the same have already stood paid to the petitioner long back in the year 2018, however, on account of pendency of the departmental proceeding, though 90% pension was paid w.e.f. the month of January, 2018, but 10% balance amount of pension and the gratuity amount was not paid to the petitioner. Nonetheless, the Office of the Accountant General (A & E),

Patna High Court CWJC No.2585 of 2021(3) dt.01-09-2022 2/2 Bihar, Patna, by a Pension Payment Order dated 25.08.2022, has ordered for payment of 100% pension and 100% gratuity, which has been sent to the office of Accountant General, Lucknow, inasmuch as the petitioner seeks to draw his pension and gratuity from Lucknow, however it is undertaken by the Additional Chief Secretary, Department of Education, Government of Bihar, Patna that the outstanding amount shall be paid within a period of four weeks from today. In view of the aforesaid statement made by the Additional Chief Secretary, Department of Education, Government of Bihar, Patna, the present writ petition stands disposed off with the hope and belief that the balance outstanding amount would be paid, within a period of four weeks from today.
