The petitioner has preferred this application for grant of regular bail in a case registered under sections 379, 386, 506 and 34 of the Indian Penal Code.
As per the prosecution case, allegation against the petitioner and other accused persons is of extortion from the occupants in the bus.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. Investigation in the case has concluded and chargesheet has been submitted under sections 384, 504, 506 and 34 of the Indian Penal Code. Section 384 is punishable with three years of imprisonment while sections 504 and 506 are bailable. The
Patna High Court CR. MISC. No.54937 of 2021(3) dt.10-05-2022 2/2 petitioner is in custody since 7.7.2021.
The application for bail is opposed by learned A.P.P. for the State who submits that the petitioner has a number of antecedents.
Having heard learned counsel for the parties and taking into consideration the chargesheet having been submitted in the case under the aforesaid sections together with the petitioner having remained in custody for 10 months, the Court directs the petitioner to be enlarged on bail in connection with Araria (R.S.) P.S. Case no.383 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria.
