JUSTICE SANJAY PRIYA ORAL ORDER 16-02-2017 Heard learned counsel for the petitioners and the State.

The petitioners apprehend their arrest in Palasi P.S. Case No. 211 of 2016 instituted for the offence under Sections 366/120(B) of the Indian Penal Code.

It has been submitted that victim girl has herself filed a petition in the court of Additional Chief Judicial Magistrate-III, Araria, stating that she was in love with Vishal Kumar Sah and she has performed marriage with Vishal kumar Sah and leading conjugal life with him.

From the written report, it appears that there is allegation against these petitioners that they along with Vishal

Patna High Court Cr.Misc. No.5994 of 2017 (2) dt.16-02-2017 2/2 Kumar Sah kidnapped the daughter of the informant. It is stated that these petitioners are husband and wife. They are villagers of Vishal Kumar Sah. They have no concern with the affairs of Vishal Kumar Sah and victim Sangita Devi. In the circumstances, prayer of the petitioners for anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Palasi P.S. Case No. 211 of 2016, they shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, subject to the conditions as laid down under Section 438(2) Cr.P.C.
