The petitioner apprehends her arrest in connection with Ghanshyampur P.S. Case No. 175 of 2016, registered under Section 304(B)/34 of the Indian Penal Code.
The accusation is of killing of Choti Devi, daughter of the informant, by her husband and in-laws due to non-fulfillment of demand of dowry.
Learned counsel for the petitioner submits that petitioner is married Nanad of the deceased and she has falsely been implicated in this case due to ulterior motive. In fact, petitioner is married with Pawan Sharma, resident of villageLallapatti, P.S. Ghanshyampur, District- Darbhanga and she used
Patna High Court Cr.Misc. No.13402 of 2017 (2) dt.01-05-2017 to reside at her matrimonial house, which is 20 K.M. distance from the place of occurrence.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Birul, Darbhanga, in connection with Ghanshyampur P.S. Case No. 175 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
