Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Chandi PS case no. 113 of 2022, registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioner herein, who is the mother-in-law of the deceased victim lady having killed the deceased victim lady on account of non-fulfilment of the demand for dowry. 4.
The learned counsel for the petitioner submits that the petitioner is innocent, she has been falsely implicated in the present case and is having a clean antecedent. The

No.48074 of 2023(2) dt.11-08-2023 2/3 learned counsel for the petitioner, at the outset, has submitted that though a general and omnibus allegation has been levelled against the petitioner, however, she be granted bail subject to the main accused person i.e. the husband of the deceased victim lady namely Mannu Kumar surrendering before the learned court below within a period of three weeks from today.

Per contra, the learned APP for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into account the materials available on record, from which, prima facie, it appears that the main accused is Mannu Kumar, who is the husband of the deceased victim lady, I deem it fit and proper to direct for release of the petitioner on bail by the learned court of A.C.J.M.-IV, Bhojpur at Ara, in connection with Chandi PS case no. 113 of 2022, subject to the husband of the deceased victim lady namely Mannu Kumar surrendering before the learned court below within a period of three weeks from today and further subject to such conditions, as may be deemed fit and proper to be imposed by the learned court below for the
Patna High Court CR. MISC. No.48074 of 2023(2) dt.11-08-2023 3/3 purposes of grant of bail to the petitioner.

The present petition stands disposed off on the aforesaid terms.
