JUSTICE SANJAY PRIYA ORAL ORDER 21-06-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Barh P.S. Case No. 260 of 2017 instituted for the offence under Sections 302, 120(B), 34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged in the written report that on 8.9.2017 informant along with the deceased Guddu Singh were brought from Barh Jail for production in the court and after production, they were returning to the Barh Jail, in the meantime, 4-5 miscreants fired upon them indiscriminately as a result of which the informant and Guddu Singh (since deceased) received firearm injury. Guddu Singh after receiving firearm injury disclosed that Sonu Monu have made firing.

The learned A.P.P. has submitted that Doctor has found two injuries on the person of the deceased. The name of this petitioner has been disclosed by Guddu Singh himself who later on succumbed to the injury.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which will be considered by the court below in accordance with law without being prejudiced by this order.
