JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-08-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 01.01.2021, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Marhowrah P.S. Case no. 55 of 2020, registered under Sections 341, 323, 325 and 307/34 of the Indian Penal Code. The accusation is that eight persons named in the F.I.R., including the petitioner, having Lathi, Stick and Iron-rod in their hand attacked on the informant Kanhaiya Kumar, when Kishan Kumar, brother of informant, rushed to save then Ranjeet Rai (petitioner) and Guddu Kumar gave iron rod blow

On hearing hulla, when Sima Devi, mother of informant, rushed there then she was also assaulted and they also snatched her gold chain from her neck. Learned counsel for the petitioner submits that while allegation has been made against the petitioner and Guddu Kumar to cause injury through iron rod at the forehead of Kishan Kumar, brother of informant, but only one injury i.e. lacerated wound over occipital region 3"X1/2" wide bone deep found, while the Doctor express his opinion about nature of injury is grievous. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra, District-Saran in connection with Marhowrah P.S. Case No. 55 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
