The earlier bail application of the petitioners were rejected vide Cr.Misc.No.26709 of 2015 dated 23.09..2015. It has been submitted that though the case was instituted for an offence under Section 307 of the IPC but none is said to have been injured in course of occurrence and hence no offence under Section 307 of the IPC is made out. Vide Annexure-4, a compromise has also taken place in between the parties. Considering the same, a notice was issued upon the Opposite Party No.2 vide order dated 09.03.2016. The counsel for the Opposite Party No.2 is present and admits that the compromise has taken

Considering the aforesaid facts and circumstances and for the ends of justice, let the above named petitioners, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with K.Hat (Sahayak) P.S. Case No. 268 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Purnea, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
