The petitioners apprehend their arrest in Parasbigha P. S. Case No. 98 of 2016 registered for the offences under Sections 447, 448, 341, 323, 504, 427, 307, 379, 354 and 34 of the Indian Penal Code.
The informant alleged that the petitioners came and asked to vacate his house. The petitioners disclosed that they have purchased his land from Ramashray Yadav but the informant disclosed that he has got this land in family partition. Leanred counsel for the petitioners submitted that there is a counter version. The petitioner no.1 lodged Parasbigha P.S. Case No. 99 of 2016. There is a land dispute between the
Patna High Court Cr.Misc. No.12725 of 2017 (2) dt.08-04-2017 2/2 parties. The informant and his two sons got simple injuries caused by the hard and blunt substance.
Considering the facts aforesaid and that there is no specific allegation against the petitioners and the informant and his sons got simple injury, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in Parasbigha P. S. Case No. 98 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
