JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2018 The petitioner is apprehending his arrest in connection with Nabinagar P.S. Case No. 60 of 2018, registered for offences punishable under Sections 379 of the Indian Penal Code. Allegation against the petitioner is of committing theft of the vehicle of the informant.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case due to land dispute and the informant is his gotia and save and except suspicion, there is nothing against the petitioner.

Learned counsel for the State opposed the prayer for bail on the ground that one witness has stated that the petitioner was seen around the vehicle.

Having heard both sides, considering the facts and

Patna High Court Cr.Misc. No.25741 of 2018 (3) dt.25-06-2018 2/2 circumstances of the case and nature of accusation, I am not inclined to grant the privilege of anticipatory bail to the petitioner, this application is accordingly dismissed.

However, the petitioner, if so desire, may surrender before the Court below and pray for regular bail and if any such application is filed, the Court below shall dispose of the same, on the merit of the case, without being prejudiced by the order of this Court.
